Terms of Service
EasyEcho is a scheduled check-in and response service operated by LifeEcho LLC. It sends check-ins by phone call or email on a schedule you choose. Recipients confirm in one step. If they do not respond, EasyEcho follows up and can alert you or a backup contact. By using EasyEcho, you agree to the following terms.
1. Service Description
EasyEcho allows you to schedule check-ins that are delivered to recipients by automated phone call or email. Recipients respond in one step—by pressing a key during a phone call or clicking a link in an email. The service tracks responses, performs automatic follow-ups when there is no reply, and can notify you or a designated backup contact.
EasyEcho is built and operated by LifeEcho LLC. All service delivery, data processing, and storage are managed by LifeEcho LLC.
EasyEcho is not intended for emergency, medical, or therapeutic purposes. If someone is in immediate danger or needs urgent help, contact emergency services (e.g. 911 in the US). EasyEcho is designed to reduce worry and improve coordination through routine check-ins, not to replace emergency response systems.
EasyEcho is committed to accessibility. If you need assistance using the platform due to a disability, contact us at support@easyecho.net and we will do our best to accommodate your needs.
2. Eligibility
You must be at least 13 years old to use EasyEcho. By using the service, you affirm that you meet this age requirement. If you are using EasyEcho on behalf of an organization, you represent that you have authority to bind that organization to these terms.
3. User Accounts
- You are responsible for keeping your account credentials secure.
- You agree to provide accurate, current, and complete information during signup.
- You may not use the service for unlawful, abusive, or harmful purposes.
- You are responsible for all activity under your account.
4. Check-Ins and Content
- You retain ownership of the check-in messages and response data you create through EasyEcho.
- You grant EasyEcho permission to store, process, deliver, and display your check-in messages and response data as necessary to operate the service, as described in our Privacy Policy.
- You are responsible for the content of the check-in messages you create.
- You are responsible for ensuring that the people you add as recipients have given appropriate consent to receive check-ins, in compliance with applicable laws.
- EasyEcho may process check-in responses using automated systems to categorize, log, and present results in your dashboard.
5. Subscription and Billing
- EasyEcho offers a free tier and paid plans. The free tier includes basic check-in and response features. Paid plans add automation, follow-ups, alerts, and expanded capacity.
- Payments are processed securely through trusted third-party providers such as Stripe. EasyEcho does not store your full payment details.
- If payment fails or is canceled, access to paid features may be paused until the issue is resolved. Your existing check-in history remains accessible.
- Pricing and plan details are listed on our Pricing section and may change from time to time. We will provide reasonable notice of pricing changes to active subscribers.
- Refund Policy: All purchases are final and non-refundable unless otherwise required by applicable law.
6. Data Retention
Check-in history and response data are retained for as long as your account is active and in accordance with our Privacy Policy. If you delete your account, your data will be scheduled for permanent deletion after a 30-day grace period unless you request immediate deletion.
LifeEcho LLC manages all data and maintains secure, compliant storage environments. While we take precautions to ensure durable storage, we do not warrant that data will be preserved without loss, corruption, or error at all times. You are encouraged to maintain your own records where appropriate.
7. Termination
We reserve the right to suspend or terminate your access to EasyEcho, in whole or in part, at our sole discretion, with or without notice, if we believe you have violated these Terms, misused the platform, engaged in unlawful activity, or acted in a way that could harm EasyEcho, other users, or third parties.
Upon termination for cause, you will immediately lose access to your account and all associated data, and we may permanently delete such data without obligation to provide a copy.
If we discontinue the service or terminate your account for reasons other than your breach of these Terms, we will make reasonable efforts to provide advance notice and an opportunity to export your data before it is permanently deleted.
You may cancel your account at any time by contacting support@easyecho.net. Upon cancellation, your data will remain accessible for a minimum of 30 days unless you request immediate deletion.
8. Limitation of Liability
LifeEcho LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of EasyEcho. Although strong security protocols are in place, we cannot guarantee absolute protection from unauthorized access or data breaches. Use of EasyEcho is at your own risk.
We are not liable for delays or failures in performance due to events beyond our reasonable control, including but not limited to acts of God, labor disputes, war, terrorism, internet or hosting failures, power outages, vendor failures or discontinuations, government actions, court orders, public health events, or natural disasters (force majeure).
EasyEcho does not guarantee delivery of check-ins or alerts. Phone calls and emails depend on third-party carriers and networks. Delivery failures, delays, or missed notifications may occur. Do not rely on EasyEcho as your sole means of monitoring someone's safety or well-being.
9. Third-Party Services
EasyEcho uses third-party services such as Twilio (phone calls), email delivery providers, Stripe (payments), and cloud hosting providers. Use of EasyEcho may be subject to the terms of those providers. We are not responsible for their services, performance, or policies.
The availability and functionality of EasyEcho depends on these providers. Outages, policy changes, or service disruptions by third parties may affect the service. We are not liable for interruptions caused by such providers.
10. Modifications to the Service
We may update, suspend, or discontinue parts of EasyEcho at any time. Where feasible, we will provide notice of major changes. We are not obligated to maintain any specific feature indefinitely.
We may discontinue the service entirely at any time. In such event, we will make reasonable efforts to provide advance notice and an opportunity to export your data.
11. Changes to These Terms
We may revise these Terms from time to time. If significant changes occur, we will notify you via email or a notice on our website. Continued use of the service after changes are posted constitutes your acceptance of the updated terms.
12. Dispute Resolution
If you have a concern or dispute regarding EasyEcho, we encourage you to contact us first at support@easyecho.net so we can try to resolve it informally.
If a dispute cannot be resolved informally, it will be governed by the laws of the Commonwealth of Virginia. Any legal action must be brought in the state or federal courts located in Richmond, Virginia.
Class Action Waiver: You agree to resolve disputes with EasyEcho on an individual basis and waive your right to participate in class action lawsuits or class-wide arbitration.
13. Communications and Consent
By using EasyEcho, you consent to receive communications from us via email related to your use of the service. These may include service reminders, account updates, and support messages.
You can opt out of promotional messages at any time by following the unsubscribe instructions. However, you may still receive essential service-related messages even if you opt out of marketing communications.
14. Feedback
We welcome your feedback to help improve EasyEcho. By submitting feedback or suggestions, you grant us the right to use that input without obligation or compensation, unless otherwise agreed in writing.
15. Indemnification
You agree to indemnify, defend, and hold harmless LifeEcho LLC and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to (a) your use of the service; (b) your content; (c) your violation of these Terms; or (d) your violation of applicable laws or the rights of any third party.
16. Disclaimer of Warranties
THE SERVICE AND ALL RELATED CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM LOSS OF DATA.
17. Miscellaneous
Survival. The provisions of these Terms that by their nature should survive termination (including ownership, warranty disclaimers, indemnity, limitations of liability, dispute resolution, and this section) shall survive termination.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
Waiver. Failure to enforce any provision is not a waiver of our right to do so later.
Entire Agreement. These Terms constitute the entire agreement between you and LifeEcho LLC regarding EasyEcho and supersede all prior or contemporaneous agreements on the subject matter.
Headings. Headings are for convenience only and do not affect interpretation.
